Typically a lawsuit is commenced by filing a complaint for damages in the appropriate court. Your attorney will make a determination as to whether or not the action is to be filed in a particular jurisdiction and venue. The complaint will typically seek recovery for your general damages (your pain and suffering, mental and physical damages and your general disability) special damages (out of pocket losses, loss of earnings, medical treatment, costs) and in some cases, punitive damages (a damage amount designed to deter bad conduct).
Lawsuits must be filed within the applicable statute of limitations. There is a definitive period in which you must file your lawsuit or be barred from doing so. Many governmental agencies also require a notice of claim long before the suit may be brought. Accordingly, it is imperative to promptly present potential legal claims to counsel to avoid your potential lawsuit from being barred by the statute of limitations or applicable government tort claim laws.
